Terms and Conditions
Data Protection
We take privacy and the protection of personal data very seriously. We only ask for and retain such personal data as is supplied by the buyer on the order form to ensure the sale can proceed, which is retained for seven years to comply with UK accountancy requirements. We have not, do not and will not sell or otherwise pass on to any third party any personal data of any buyer or person who has made an enquiry in the course of day-to-day business without their written permission. We may pass on such personal data as we hold to third parties including law enforcement agencies or other artwork dealers where there is suspicion or evidence of criminal, fraudulent or unethical activity relating to the sale and purchase of original artwork.
How To Buy
We have not set up a shopping basket or payment facility on this website so that we can ensure the availability of every piece of art before an order is accepted.
If you would like to buy any artwork, please complete an order enquiry form with details of the page(s) you are interested in. Please only use this form if you genuinely want to buy the piece(s) and have the funds to do so.
We will not reserve artwork under any circumstances. If there are multiple requests for a single piece of art, priority will be given to the order in which the email requests were received.
On receipt of an order enquiry form, we will confirm the price (which we reserve the right to amend based on prevailing exchange rates, human error or other reasons), email a low-resolution scan and send an order form that must be completed and emailed back before an order is complete and payment will be accepted.
Returns
Each piece of original comic art is unique and irreplaceable. As such we do not accept returns for any reason. We will send a low-resolution scan of each piece before the buyer agrees to purchase. The buyer agrees to waive any buyer/user protection policy that may be associated with their chosen method of payment.
Signatures, Personalisation and Photos
All art will be signed by Ian Churchill. If there are any special requests regarding wording, personalisation or placement of the signature please specify on the order form. If for any reason the request can’t be fulfilled we will contact you before the order is complete. There is also the option of having a photo of Ian holding your artwork/commission – please specify on the order form. There is no extra charge for these options.
Timescales
We try to respond to all emails within 2 working days, but please take into account time zones and bear with us if we get very busy. In the unlikely event that you have not heard from us within 5 working days then please first check your junk/spam mailbox before re-sending your email or sending a message via Ian’s Facebook page.
Payment Options
Once a completed order form has been received payment is due within 3 working days.
We accept as standard payment in US$, GBP (£) and Euro (€). Please contact us for a price in another currency.
We accept payment by bank transfer and PayPal. Details will be given on the order form. Due to the number of PayPal payments coming through with fees automatically deducted, we reserve the right to add 6% to the total cost of the order to cover PayPal fees.
We will consider accepting payment from alternative providers. Please contact us if you have experience of or would like to pay using an alternative.
Pricing and Discounts
Prices on the website are fixed and non-negotiable. Please do not contact us with an offer for a piece or ask for a ‘best price’. At our discretion we may consider a discount for a single private buyer wanting to purchase multiple pieces of a similar value. Please request a quote in the order enquiry form.
Lost or Damaged Goods
We securely package artwork before shipping to minimise the likelihood of damage. We cannot be held responsible for any damage or loss to packages once we have handed them over to Royal Mail or another shipping agent.
In the unlikely event that artwork sent by a tracked/signed for service is lost or damaged beyond repair, we will pursue a compensation claim. The buyer agrees to fill out forms and provide evidence of payment as needed. For damaged goods, the buyer agrees to keep all packaging and the artwork and be prepared to submit photographic evidence of the damage as needed.
In the unlikely event that a commission piece is lost or damaged beyond repair, the buyer will have the option to have the piece redrawn or accept a refund. If a refund is chosen, the buyer agrees to fill out forms and provide evidence of payment as needed. For damaged goods, the buyer agrees to keep all packaging and the commission and be prepared to submit photographic evidence of the damage.
In the unlikely event that artwork is lost in transit, different shipping agents have different rules regarding when a package is deemed to be lost. We will keep the buyer appraised of any developments, but the process will be beyond our control and we will be unable to issue any refund/replacement art until the timeframe specified by the agent has passed.
For UK buyers, we will issue a full refund of the insured amount. For example, if the buyer purchases art worth £100 but chooses a postage option that insures it to £50, they will be entitled to a refund of £50 plus postage and packaging charges. If the buyer prefers, we can instead offer replacement art to the insured value, with no delivery charge.
For international buyers, we will issue a full refund plus postage and packaging charges. If the buyer prefers, we can instead offer replacement art of the same value, with no delivery charge.
Custom Duties and Import Tax
We are based in and all art is shipped from the UK. The buyer is responsible for verifying and paying any import duties imposed by their country’s customs. Currently, original art shipped to EU/EEAA destinations and the US should not incur customs duties.
